What is SPORT NEEDS?

SPORT NEEDS is a brand dedicated to the e-commerce of high-performance sports products, through the exclusive distribution and marketing of these products via online sales from the website https://sport-needs.com/ active in Europe and Andorra.

User registration

To access as a registered user of SPORT NEEDS and make any purchase, the registration form must be completed fully and truthfully. It is essential to be over 18 years old. It is strictly prohibited to provide data of third parties, even with their consent.

SPORT NEEDS reserves the right not to accept or deactivate any false or incomplete registrations.

Contracting procedure

The procedure for making any purchase must follow the following phases:

1. User registration: before carrying out any commercial transaction, it will be necessary to complete the registration form provided for this purpose. In this form, users can review the contracting conditions, as well as the legal notice and cookie policy regarding the use of the Website and the personal data provided throughout the process.
2. Product selection: through the different available catalogs, users can select the desired product or configure a custom pack. Additionally, Customers will have the option to customize product packs.
3. Product acquisition / Start of the contracting procedure: once the product is selected, it will be added to the shopping cart. Users can review their purchase at any time in this section before making the payment. In this section, and prior to the start of the commercial transaction, users must read and accept this document of general contracting conditions. Otherwise, the sale cannot be completed.
4. Payment method selection: users will be able to make the payment for the purchase through the means provided on the purchasing platform.
5. Purchase confirmation: before completing the transaction, users must accept the transaction and agree to the terms and conditions under which it is carried out. Once the purchase is made, the user will receive a confirmation email; otherwise, the Customer must contact SPORT NEEDS via email at info@sport-needs.com.
6. Product shipping: the product will be sent within the specified time frames to the address provided by the user at the time of registration.

Prices

Once registered, users will be able to purchase the offered items. Registration and acceptance of these conditions imply agreement with the product and its characteristics and the price, expressed in euros.

The prices of the products available for sale on the website represent the final price with all taxes included, unless a different issue is indicated and applied due to legal requirements, especially regarding VAT. Only shipping costs are excluded, which will be included at the time of finalizing the purchase and, in any case, prior to the start of the commercial transaction.

Offers will be properly marked and identified as such, conveniently indicating the previous price and the offer price.

SPORT NEEDS reserves the right to make modifications on the website at any time and without prior notice, being able to update products and services based on the market.

Withdrawal

The Customer has a period of 14 calendar days from the date of delivery of the purchased product (except for nutrition and nutritional supplements) to withdraw from the contract, without indicating the reasons for such a decision, with the right to a full refund of the amounts paid, without any formalities required, as long as it is evidenced in any legally accepted form, and without this implying any penalty other than the direct cost of returning the materials, if applicable.

To exercise this right, the Customer must notify SPORT NEEDS of their decision to withdraw from the contract through an unequivocal statement (for example, a letter sent by postal mail, fax, or email). For this purpose, they may use the model of withdrawal document which is included as an Annex to these General Sales Conditions, although it is not mandatory, and it can be sent later to the contact address listed on the invoice.

Once the withdrawal request is received and processed, the amounts paid by the Customer will be refunded, and a documentary confirmation of the same will be sent, as well as the acceptance of the withdrawal request.

Exceptions to the right of withdrawal

Due to health and hygiene protection reasons, we do not accept the return of nutritional products such as gels, drinks, dietary supplements, or unsealed bars, including the opening of the box containing the product.

The right of withdrawal does not apply and therefore cannot be exercised once the product has been opened or unsealed, in accordance with the provisions of Article 103 e) of Law 3/2014, of March 27, which amends the consolidated text of the General Law for the Defense of Consumers and Users and other complementary laws, approved by Royal Legislative Decree 1/2007, of November 16, which approves the consolidated text.

Return Policy

Legal right to withdraw from the purchase. Exchange or return procedure.

If you purchase our products as a consumer, you may withdraw from the products you bought within a period of fourteen calendar days from when the user or a third party indicated by them, other than the carrier, takes possession of the product.

However, due to health and hygiene protection reasons, we do not accept the return of opened gels, beverages, dietary supplements, or unsealed bars, including the opening of the box containing the product.

To be able to make a return, you must notify us within fourteen (14) days following the delivery or collection of the order. To do this, send us an email at hola@sport-needs.com or by postal mail to the address that appears at the end of this page.

The notification you send us must include the following information.

Before the withdrawal period expires, the consumer and user will communicate to Sport Needs their decision to withdraw from the contract. To this end, the consumer and user may use the model withdrawal form included in the Annex to these Conditions; or make another type of unequivocal statement indicating their decision to withdraw from the contract via email at hola@sport-needs.com.

Must include:

• order number of the delivery,
• your name and contact information, and
• a specification of the product or products to be returned.

You are responsible for the return of the products, which means that the return is at your expense and you are responsible for any damage that the products may suffer during shipping. Therefore, make sure that the products are well packaged during shipping.

When the returned products are in the SPORT NEEDS warehouse, they will be verified, and if everything is correct, the refund for the products will be initiated, deducting the shipping costs and the return processing fee (valued at €10). In the case that the return is due to an incident on the part of SPORT NEEDS, no additional cost will be applied, refunding 100% of the order amount.

Sport Needs reserves the right to compensation for the difference between the value of the items sent to the customer and returned by them in the following cases:

• When the products have been used or handled improperly or negligently or not in accordance with their characteristics by the Customer.
• When the products have been hit or damaged.
• When the return by the customer is not made in its box.
• When the lack of conformity is due to wear from normal use.
• If any of the details on the ticket or proof of purchase are modified, altered, or replaced.
• If all its elements, accessories, cases, or boxes are not returned with the product.

You will receive the refund as soon as possible and always before fourteen (14) days from the date of receipt of the returned shipment. The refund will be credited using the same payment method you used to make the payment, unless another method is agreed upon.

Warranty. Return of non-compliant products.

Despite our strict quality controls, due to causes beyond our control, you may receive an unwanted item, with a manufacturing defect or in poor condition. SPORT NEEDS is responsible for this under the terms established in consumer protection legislation.

According to this regulation, products have a two-year warranty from the date of delivery. The consumer must report the lack of conformity within two months from the time they became aware of it.

We ask that as soon as you notice that the product is not compliant, you contact our customer service reporting the incident.

SPORT NEEDS is not responsible for negligent or improper use of the purchased product.

In the case of a defective or damaged product, the consumer may choose its repair or replacement, price reduction, or contract resolution, as long as the nature of the product allows for the first option. In general, our products only allow for replacement. Our carrier will take care of picking up the defective product. It is essential to include a copy of the sales invoice.

Once the conditions for product replacement are verified, a new one will be sent to you without delay. All procedures will be completely free for the consumer.

Claims regarding defective products must be reported to us as soon as the defect is noticed by sending a properly completed complaint email to info@sport-needs.com or by postal mail to the address at the end of this page. We will send you a confirmation of the claim notification indicating the return address, in case the product needs to be returned, and any other necessary information if you are entitled to return the product or products.

The notification you send us must include the following information:

• order number of the defective product(s)
• your name and contact information and
• a specification of the defective product(s) and the defect being claimed.

Reservation of Rights

• SPORT NEEDS reserves the right not to admit or deactivate users whose data is false, incorrect, or incomplete.
• SPORT NEEDS reserves the right to cancel or reject any order from a Customer with whom there is a conflict related to the payment of a previous order or that appears to present some type of risk.
• SPORT NEEDS reserves the right to modify the prices of its products. The purchase price will be the current one at the time of closing the transaction.
• SPORT NEEDS reserves the right to verify the personal information provided by the customer and take the measures it deems necessary to ensure that the registered person is the holder of the documents or cards used for payment. This verification may take the form of a request for proof of identity and/or address and/or banking documents. If the customer does not respond to such a request within two days of its issuance, the order in question will be automatically canceled, with no possibility of filing a subsequent claim.
• SPORT NEEDS reserves the right to deactivate those who are misusing or abusing the system, committing fraudulent acts, or harming other users. If SPORT NEEDS or any entity professionally linked to it detects any anomaly or suspects that a user is preventing the normal operation of the system by illegally altering its records through any technical or computer procedure, or carrying out any fraudulent acts that contravene its transparency, it reserves the right to deactivate and withdraw the benefits that may have been obtained automatically and without any explanation from all users who have directly or indirectly benefited from such fraudulent actions, and may also exercise all civil or criminal actions that may correspond. In this regard, SPORT NEEDS declares that it has enabled suitable mechanisms and technological supports to detect any possible fraudulent, anomalous, or malicious actions intended to alter the record and proceed on this site.
