Legal right to withdraw from the purchase. Procedure for exchange or return.

If you purchase our products as a consumer, you may withdraw from the products you bought within a period of fourteen calendar days from the moment the user or a third party designated by him, other than the carrier, takes possession of the product.

However, for health and hygiene reasons, we do not accept returns of opened gels, beverages, dietary supplements, or unsealed bars, including the opening of the box containing the product.

To make a return, you must notify us within fourteen (14) days following the delivery or collection of the order. To do this, send us an email at hola@sport-needs.com or by postal mail to the address at the end of this page.

The notification you send us must include the following information.

Before the withdrawal period expires, the consumer and user will communicate to Sport Needs their decision to withdraw from the contract. To this end, the consumer and user may use the withdrawal form model included in the Annex to these Conditions; or make another type of unequivocal statement indicating their decision to withdraw from the contract via the email hola@sport-needs.com.

You must include:

  • order number of the delivery,
  • your name and contact information, and
  • a specification of the product or products to be returned.

You are responsible for the return of the products, which means that the return is at your expense and you are responsible for any damage that the products may suffer during shipping. Therefore, make sure that the products are well packaged during shipping.

When the returned products are in the SPORT NEEDS warehouse, they will be verified, and if everything is correct, the refund for the products will be initiated, deducting the shipping costs and the return management fee (valued at €10). In the case that the return is due to an incident on the part of SPORT NEEDS, no additional cost will be applied, refunding 100% of the order amount.

Likewise, Sport Needs reserves the right to compensation for the difference between the value of the items sent to the customer and returned by them in the following cases:

  • When the products have been used or handled improperly or negligently or not in accordance with their characteristics by the Customer.
  • When the products have been hit or damaged.
  • When the return by the customer is not made in its box.
  • When the lack of conformity is due to wear from normal use.
  • If any of the data on the ticket or proof of purchase is modified, altered, or replaced.
  • If not all elements, accessories, cases, or boxes are returned with the product.

You will receive the refund as soon as possible and always before fourteen (14) days from the date of receipt of the returned shipment. The refund will be made using the same payment method you used to make the payment, unless otherwise agreed.

 

Warranty. Return of non-conforming products.

Despite our strict quality controls, for reasons beyond our control, you may receive an unwanted item, with a factory defect or in poor condition. SPORT NEEDS is responsible for this under the terms established in consumer protection legislation.

According to this regulation, products have a two-year warranty from the date of delivery. The consumer must report the lack of conformity within two months from the time they became aware of it.

We ask that as soon as you notice that the product is not conforming, you contact our customer service to report the incident.

SPORT NEEDS is not responsible for negligent or improper use of the purchased product.

In the case of a defective or damaged product, the consumer may choose to have it repaired or replaced, a price reduction, or the resolution of the contract, provided that the nature of the product allows for the first option. In general, our products only allow for replacement. Our carrier will take care of picking up the defective product. It is essential that you include a copy of the sales invoice.

Once the conditions for the replacement of the product are verified, a new one will be sent to you without further delay. All procedures will be completely free for the consumer.

Claims regarding defective products must be notified to us at the same time the defect is perceived by writing us a properly completed claim email to info@sport-needs.com or by postal mail to the address at the end of this page. Shortly, we will send you a confirmation of the claim notification indicating the return address, in case the product needs to be returned, and any other necessary information in case you are entitled to return the product or products.

The notification you send us must include the following information:

 

  • order number of the defective product(s)
  • your name and contact information and
  • a specification of the defective product(s) and the defect being claimed.
Defective products will be refunded in accordance with the current legislation regarding customer protection. In the case of a defective or damaged product, the consumer may choose to have it repaired or replaced, a price reduction, or the resolution of the contract, provided that the nature of the product allows for the first option. In general, our products only allow for replacement.

Additionally, we will refund any shipping costs incurred from the return of defective products. The refund will be made within thirty (30) days from the date of receipt of the returned shipment. The refund will be made using the same payment method you used to make the payment, unless otherwise agreed.

If you believe that a purchased product is defective, but we do not agree, we are facing a conflict. To address such a conflict, if you purchased those products as a consumer, you may have the right to have that conflict evaluated by an alternative dispute resolution body. The alternative dispute resolution bodies that may be relevant to you are as follows:

  1. if you reside in the European Union, you can resort to the online dispute resolution of the European Union at http://ec.europa.eu/odr.
  2. if you reside outside of Europe, you can resort to the previous online dispute resolution or contact your local authorities.

Limitation of Responsibilities

SPORT NEEDS is not responsible for technical failures that due to fortuitous causes or other reasons prevent the normal functioning of the service through the internet, nor for the lack of availability of the site for maintenance reasons or others, which prevent access to the service.
